Exception was taken to the indictment, because it was tali die, et uno, &c. in messuagio, &&. existent, libefnim tenementum J. S. intravit, et ipsum J. S. expidit el disseisivit. And he doth not say, adtunc existent, liberum tenementum; for otherwise, existent, libemm tenementum may refer to the time of the indictment taken.-And for this cause he was discharged.
