In an action for damages for personal injuries in which special damages for loss of earnings were sought, the defendant served a notice for further and better particulars of the plaintiff's earnings for the two years prior to the accident. On receiving a reply that the plaintiff was not employed in those years, the defendant then served a notice for particulars of the plaintiff's employment and earnings for the ten years prior to the accident. The plaintiff replied that the defendant was not entitled to any further information as none of the matters was alleged in the statement of claim. The defendant then applied to the court for an order that the plaintiff give further and better particulars of matters "arising out of the statement of claim".
