THE
SMALL LOTTERIES AND GAMING ACT, 1956
THIS Act, which came into force on 5th August, 1956,
authorises the conduct of small lotteries for other than
private gain by societies for raising money for charitable,
sporting
and
other purposes and amends the law with respect
to gaming.
Section Iapplies to any lottery promoted in Great Britain
on behalf of a society registered by the local authority
under
this Act, being a society established
and
conducted for charit-
able purposes
or
participation in or support of athletic sports,
games or cultural activities or for other purposes not being
purposes of private gain or of any commercial undertaking
and
which is promoted for raising money to be applied for the
purposes of the society. Such lotteries are deemed
not
to be
unlawful if conditions are observed respecting the authorisa-
tion of
the
promoter, his remuneration
and
that
of any person
employed by him,
the
application of the proceeds,
the
amount
appropriated for expenses and prizes, advertisements, particu-
lars to be shown on tickets, the sending of tickets through
the
post and the sale of tickets by or to persons
under
16. No
prize shall exceed £ 100; the price of a ticket or chance shall
not exceed one shilling;
the
price of a ticket shall be stated on
it and all tickets or chances shall be the same price; the receipts
shall not exceed
£750;
no person shall participate except after
payment of the whole price of the ticket or chance,
and
no
money shall be returnable and no expenses or prizes shall be
paid out of moneys of the society
not
being proceeds of the
lottery.
If
any condition is contravened the promoter
and
any
other person who is party to the contravention shall be guilty
of an offence.
There
is a proviso
that
it shall be a defence for a
person charged only by reason of his being the promoter to
