THE
CRIMINAL
JUSTICE ADMINISTRATION ACT, 1962
THIS Act makes important administrative changes to assizes
and quarter sessions andextends
the
jurisdictionof quarter
sessions and magistrates' courts.
EXTENSION OF
JURISDICTION
OF QUARTER SESSIONS
Quarter sessions with a legally qualified chairman are to
have jurisdiction to
try
the
following offences which were
previously triable only at assizes (s. 12 (I) and Second
Schedule)-
Bigamy, and offences against
the
laws relating to
marriage;
Offences
under
s. 9 of
the
Night
Poaching Act, 1828
(night poaching by three or more armed persons);
Offences
under
s. 6 of
the
Sexual Offences Act, 1956
(intercourse with girl between thirteen and sixteen)
and attempts to commit such offences.
The
jurisdiction of quarter sessions
under
para. 6 of
the
First Schedule to
the
Criminal Justice Act, 1925, to
try
certain forgery offences which is at present limited to cases
where the value or amount concerned does not exceed twenty
pounds is extended to those where
the
value or amount does
not
exceed one
hundred
pounds (s. 12 (2)
and
Second
Schedule).
EXTENSION OF
JURISDICTION
OF MAGISTRATES' COURTS
The
jurisdiction of magistrates' courts is extended by
amending
the
First Schedule to the Magistrates' Courts Act,
1952 (which specifies indictable offences triable summarily
with
the
consent of the accused
under
s. 19 of that Act).
The
undermentioned offences are now included in
the
First
Schedule to the 1952
