LATCH, J7. CROUCH V. HAIN 273 [57] ceouch versus hain. Ejectione firme en le Common Bane le plaintiff ad judgement la, & le defendant port error en le B. R. lou le judgement fuit affirme, & donque il port error en Parliament, & le Chief Justice, come le course est, apporter le record en Parliament. Ore per le mort del Roy Jaques le Parliament fuit dissolve, & le plaintiff pria execution. Damport; Le error est abate per act del Dieu, & nemy per Tact del party. Et c est le difference, que lou error abate per act del partye. Secondemerit, le breve d'error ne serrera un supersedeas : mes quand per act del Dieu auterment. Et nous priomus, q^ voua voyl stayer execution tanq, prochein Parliament. Noy argue al contra, & comentq, le party avera novel breve d'error dependant en Parliament, q^ unc ceo ne serra supersedeas. Et il dit, que poet bien estre doubt, si error en Parliament fuit ascun supersedeas omnino, quia le recorde remain icy. Et 1 H. 7. 19. si home est prisb en execution sur un judgement en le B. R. si il port error en Parliament; il ne serra estre bayl: auterment si soit en execution sur un judgement en C. B. & port error en le B. R. la serrera estre bayled. Second 1'icy appiert deatre un delay quia port error en fine del Parliament, & sur le breve d'error en ceo Court ne assigne error tan que le scire facias fuit sue vers luy, & issint n'ad assigne ascun errors en Parliament.
