An Act to confer powers upon the Corporation
of
tlie

borough of Darwen with respect to the
working
:~id
construction
of
tramways in the borough
to
confer
further powers on the
said
Corporation with respect to
their waterworks undertaking and in regard to streets
buildings sewers and drains
and
for
the health local
government and improvement
of
the borough to make
further provisions for the collection and recovery
of
rates
for
the borrowing
of
money and
for
other purposes

HEREAS
the mayor aldermen and burgesses of the borough
of Darwen (in this Act called
"
the Corporation
")
are
also
the
urban sanitary authority
for
the borough
:
Bud whereas extensive powers with regard to gas water electric
lighting and the improvement and government
of
the borough
have bven conferred upon tlie Corporation by the Acts and Orders
specified in the
First
Schedule to this Act
:
Ani whereas by section 61
of
the Blackburn and Over Darwen
Tramways Act 1879
an
option
of
purchase
is
given to the Corpora-
tion
of
so
much
of
the tramway undertaking by that Act authorised
as
lies wit)hin the borough which option has been duly exercised
and
the Corporation are or shortly
will
be the owners
of
such part
of
the said tramway undertaking
:
And whereas
it
is
expedient that the Corporation should
he
authorised to maintain and work such part
of
the said tramway
undertaking
as
aforesaid
and
also
to construct and work the
tramways
by
this
Act authorised
:
And whereas
it
is
expedient that the tramway service
in
the
borough should be improved and that new methods
of
traction
on
the tramways within the borough should be adopted and that.
all
or
some
of
the existing tramways should be reconstructed for
that
purpose
:

And whereas under the Darwen Corporation Electric Lighting
Order
1897
tho Corporation are the Undertakers
for
supplying
electric power
or
energy within the borough
and
it
is expedient
that the Corporation should be authorised to use electric
or
other
mechanical power on the tramways
so
acquired
as
aforesaid and
the tramways
by
this Act authorised
to
be constructed by them
:
And whereas
it
is
expedient
that
the Corporation should be
authorised to conbtruct the new streets and the street improvements
and other
works
by this Act authorised
:
And
whsreas by the Over Darwen Local Board Waterworks
and Gasworks Act
1873
the undertakings of the Darwen Water-
works
Company and
of
the Over Darwen
Gas
Light Company
respectively were vested in *the Local Board of Health for the
district
of
Over Darwen who
are
now represented
by
the
Corporation
:
And whereas it
is
expedient that the Corporation should
bc
authoriscd to acquire such part
of
the lands forming the water-
shed of their watw undertaking
as
does not already bclong to
them and to execute the additional waterworks
by
this Act
authorised
:
And whereas plans and sections showing the lines situation and
levels of the works by this Act authorised and plans of the lands
to be acquired and also
a
book
of
reference to such plans containing
the names
of
the owners
or
reputed owners lessees
or
reputcd
lessees
ancl
of
the occupiers
of
the lands which may be taken
for
the purpoces
or
under the powers of
this
Act were cluiy deposited

with the clerk
of
the peace
for
the county
of
Lancaster and
are
in
this Act respectively referred
to
as the deposited plans sections
and book of reference
:
And whereas it is expedient that further powers should be
conferred
upon
the Corporation
with
reference
to
streets buildings
sewer6 and
drains
within tbe borough an? further provision made
for
the health local government and improvement of the borough
:
And whereas
it
is
expedient
to
confer further powers upon the
Corporation with respect to the assessment of property within
the borough and the levying of rates and that the date
for
closing the financial year
in
respect of the electric lighting accounts
of
the Corporation should be altered
:
And whereas it
is
expedient that the Corporation should be
authorised to raise further money by borrowing
for
the purposes of
this Act and for other purposes
as
in this Act set forth
:
And
whereas estimates have been prepared by the Corporation
for
the purchase
of
land
for
and the executiou
of
the various
works

And whereas the several works included in such estimates are
permanent works within the meaning
of
:
And whereas
an
absolute majority
of
the whole number
of
the
couticil
at
a meeting held
on
the seventeenth day
of
November
one thousand eight hundred and ninety-eight after ten clear days’
uotice by public advertisement of such meeting and
of
the purpose
thereof in the Darwen News
a
local newspaper published and
circulating
in
the borough such notice being in addition to the
ordinary notices required
for
summolling such meeting resolved
that the expense in relation to promoting the Bill for this
Act
should be charged on the borough fund and borough rate
:
And whereas such resolution was published twice in the Darwen
News
a newspaper published and circulating in the borough and
has received ths approval
of
the Local Government Board
:
And whereas the propriety
of
the promotion of the Bill
for
this Act
was
confirmed by an absolute majority
of
the council
at
a
further special ineeting hehl
in
pursuance of
a
similar notice
on the twenty-sixth day
of
January one thousand eight hundred and
ninety-nine being not less than fourteen days after the deposit
of
the Bill in Parliament:
And whereas the owners and ratepayers of the borough by
resolution in the manner provided
in
the Third Schedule
of
the
consented to the promotion
of
the Bill
for
this Act
:
And whereas the purposes
of
this Act cannot be effected without
the authority
of
I’arliament
:
May
it
therefore please Your Majesty that
it
may be enacted and
