BACKGROUND AND PLEADINGS
1. On 20 October 2019, Vladimir Lavrentiev (“the applicant”) applied to register the
trade mark shown on the cover page of this decision in the UK. The application was
published for opposition purposes on 22 November 2019 and registration is sought for
the following goods and services:
Class 16 Adhesive labels.
Class 25 Clothing.
Class 36 Political fund-raising services.
Class 45 Organisation of political meetings.
2. On 24 February 2020, the application was opposed by THIS AIN’T ROCK N’ ROLL
LIMITED (“the opponent”) based upon sections 5(4)(a) and 3(6) of the Trade Marks
Act 1994 (“the Act”).1 Under section 5(4)(a), the opponent claims to have used the
following sign throughout the UK since May 2018 in relation to “advertising signboards,
badges, posters, papers, flags, clothing, advertising, publication of printed matter,
advertising campaigns, transmission of news, production of films, education services
relating to environmental issues, education services relating to conservation of the
environment, news reporting, organisations of meetings and conferences, providing
scientific information in the field of global warming and climate change, research
relating to environmental protection, compilation of information relating to
environmental conditions”:
