1. BRKR.IO, INC. (“the applicant”), applied to register the figurative trade
mark shown on the front page of this decision in the United Kingdom on 3
February 2021. It was accepted and published in the Trade Marks Journal
on 2 April 2021 in respect of the following services:
Class 41: Entertainment information services, namely, providing
information and news releases about a musical artist; Entertainment
services, namely, providing non-downloadable prerecorded music,
information in the field of music, and commentary and articles about
music, all on-line via a global computer network; Entertainment
services, namely, providing advice and information for music
production, marketing and promotion; professional coaching services
for musical artists.
Class 42: Providing an interactive web site featuring technology that
enables users to upload music and search and connect with third
parties for publication, distribution and promotion of music.
2. The applicant provided a fall-back position by letter, dated 7 December
2021, seeking registration of a narrower specification of services in relation
to Class 41, namely:
Class 41: Entertainment information services, namely, providing
information and news releases about a musical artist; Entertainment
services, namely, providing non-downloadable prerecorded music,
information in the field of music, and commentary and articles about
music, all on-line via a global computer network; Entertainment
