Action for recovery of rent against tenant and surety - Void and illegal contract.
D. let premises to J. by agreement in writing which contained no reference to the purpose for which premises were to be used. At the date of the contract of tenancy, the premises were sublet by a former tenant to J. who was carrying on therein the business of a ready-money bookmaker. Held, that since letting was to the knowledge of the plaintiff's agent for the purposes of carrying on the business of a ready-money bookmaker, such purposes being illegal, the rent payable under the agreement could not be recovered.
