DEPOT ACCESS AGREEMENT BETWEEN SOUTHERN RAILWAY LIMITED AND
FIRST CAPITAL CONNECT LIMITED FOR SELHURST LIGHT MAINTENANCE DEPOT,
WHERE SOUTHERN RAILWAY LIMITED IS THE DEPOT FACILITY OWNER
1. Pursuant to section 17 of, and in accordance with paragraph 5 of Schedule 4 to, the
Railways Act 1993, and having consulted you Southern Railway Limited and First
Capital Connect Limited as the persons who are stated in an application made on
11 May 2012 to be parties to a proposed access agreement, I hereby direct you,
Southern Railway Limited to enter into the attached Depot Access Agreement by 11
January 2013.
2. The proposed agreement has been given the unique Office of Rail Regulation
(ORR) reference number DAA/14/215/04/12/01. The principal copy of the proposed
agreement has been deposited with the Office of Rail Regulation and carries the
ORR unique reference number.
3. You, Southern Railway Limited, shall be released from the duty to enter into the
agreement in question if First Capital Connect Limited fails to enter into the
proposed agreement by 11 January 2013.
4. A copy of these directions has been sent to First Capital Connect Limited.
