Section 17 Railways Act 1993: Depot Access Agreement between Abellio East
Midlands Limited (Depot Facility Owner) and Hitachi Rail Limited (Beneficiary)
for Leeds Neville Hill depot where Abellio East Midlands Limited is the Depot
Facility Owner

1. Pursuant to section 17 of, and in accordance with paragraph 5 of Schedule 4 to,
the Railways Act 1993, and having consulted you Abellio East Midlands Limited
Limited and Hitachi Rail Limited as the persons who are stated in an application
made by Hitachi Rail Limited on 21 February 2020, to be parties to a proposed
access agreement. I hereby direct you, Abellio East Midlands Limited to enter into
the attached Depot Access Agreement by 2 June 2021.
2. Hitachi Rail Limited should enter into the proposed agreement by the same date.
If it fails to do so, Abellio East Midlands Limited shall be released from the duty to
enter into the access agreement.
3. A copy of these directions has been sent to both parties and will be retained on
ORR’s public register.
