The District Court Fees Order 1984

In exercise of the powers conferred on me by section 2 of the Courts of Law Fees (Scotland) Act 1895(a) and of all other powers enabling me in that behalf, and with the concurrence of the Treasury, I hereby make the following order:—

Citation, commencement and interpretation

1.—(1) This order may be cited as the District Court Fees Order 1984 and shall come into operation on 1st April 1984.

(2) In this order "clerk of the district court" includes any depute clerk of the district court.

Fees payable to district courts

2.—(1) Subject to article 3 of this order, the fees payable to a district court in respect of the matters specified in column 1 of the Table of Fees in the Schedule to this order shall be the fees specified in relation to those matters in column 2 of that Table.

(2) The fees payable under this order shall be paid to the clerk of the district court.

3. The fees regulated by this order shall not be payable by the Crown (including any officer of the Crown as such or government department).

EXPLANATORY NOTE

(This Note is not part of the Order.)

This Order makes new provision for the fees payable to district courts in Scotland. The only fees payable are a fee in respect of a complaint (the document initiating summary criminal proceedings) and fees in respect of the extracting or copying of documents.
