THE DOMINICA (ADAPTATION OF LAWS) ORDER IN COUNCIL, 1939.

PKESENT,

The King's Most Excellent Majesty in Council.

Whereas by the Dominica Act. 1938, it is provided that on such day as His Majesty may by Order in Council appoint (in that Act and in this Order referred to as "the appointed day") Dominica shall cease to be one of the Presidencies constituting the Colony of the Leeward Islands and shall become a separate colony:

And whereas by the said Act His Majesty is empowered by Order in Council to make such provision as he thinks proper for the government of Dominica on and after the appointed day, and to delegate to any authority constituted for Dominica (whether by virtue of the Order or otherwise) power to make laws for the peace, order and good government of Dominica; and it is provided that any such Order made before the appointed day, and delegating any power to make laws to an authority already in existence at the time of the making of the Order, may be so framed as to enable that authority to exercise the delegated power as from the making of the Order, so, however, that no laws made in exercise of that power shall take effect before the appointed day:

And whereas by the Dominica Order in Council, 1989 (a), it is provided that the appointed day shall be the first day of January, 1940, and provision is made for the government of Dominica on and after the appointed day:

And whereas by the said Order it is further provided that all Acts of the Legislature of the Leeward Islands, Ordinances, Regulations and other enactments and instruments having the force of law in Dominica immediately before the appointed day shall, except so far as the same shall, on or after that day, in their application to Dominica be repealed, amended or otherwise affected by or under any Order of His Majesty in Council or any law made under the Order or by other lawful authority, continue to have effect in Dominica but shall be construed subject to such modifications as may be necessary to bring them into conformity with the provisions of the Order and of the Dominica Act, 1938:

And whereas it is expedient that modifications and adaptations should be made in certain of the said Acts, Ordinances, Regulations, enactments and instruments to take effect on the appointed day:
