The East Birmingham Hospital National Health Service Trust (Establishment) Amendment Order 1994

The Secretary of State for Health, in exercise of powers conferred on her by section 126(3) of the National Health Service Act 19771and section 5(1) of the National Health Service and Community Care Act 19902hereby makes the following Order:

S-1 Citation, commencement and interpretation

Citation, commencement and interpretation

1.—(1) This Order may be cited as the East Birmingham Hospital National Health Service Trust (Establishment) Amendment Order 1994 and shall come into force on 28th October 1994.

(2) In this Order unless the context otherwise requires—

“The Order” means the East Birmingham Hospital National Health Service Trust (Establishment) Order 19913.

“The Trust” means the National Health Service trust established by the Order.

S-2 Amendment of the Order

Amendment of the Order

2. In the Order—

(a) at the end of article 3(2) there shall be inserted the words “(including the management of teaching and research facilities)”.

(b) article 4 shall be renumbered 4(1) and after article 4(1) there shall be inserted the following paragraph—

“2 Since the trust is to be regarded as having a significant teaching and research commitment within the meaning of paragraph 3(1)(d) of Schedule 2 to the act, one of the non-executive directors shall be appointed from the University of Birmingham.”

This Order amends the East Birmingham Hospital National Health Service Trust (Establishment) Order 1991, which established the NHS trust now known as the Birmingham Heartlands Hospital National Health Service Trust, by inserting provisions for the Trust to have a non-executive director appointed from a University.
