Burgesses

Eccles to reconstruct their existing
and
to
construct additional tramways
to
make street
improvements to raise additional moneys
by
mortgage
and to make further provisions for the
good
government
of
the borough. [26th July

HEREAS
the borough
of
Eccles (hereinafter called
cc
the
borough”j is subject
to
the Acts relating
tu
municipal
corporations and under the local gove rnmciit
of
the mayor
alderman and burgesses
of
the borough (hereinafter called

Corporation
”)
acting by the
town
council
:
And
whereas the several Provisioiial
Orders
mentioned
in
tlkG
First Scheclulc
to
this Act
or
parts thereof are in force within
the
borough each
of
which Orders is in this
Act
referred
to
separately
as
an
Order of
the
year in
which
the same was macle
:
And
whereas
under
tlie powers
of
the Order
of
1S77
the
Corporation have constructed various tramways
in
tlie
borougil
which
are
worked by their lessees under
a
lease wliicli will expire
on tlie twenty- seventh day
of
April one thousaiid iiine hundred
and
one:
And
whereas tlie Corporation were by the
Orcler
of
1899
empowered subject
to
any subsisting leases
to
run carriages on
their tramwa>-s
and
take tolls
in
respect
of
the use
of
such
carriages and
it
is expedient
that
the Corporation should
be
authorised subject to the terms
of
the said lease
to
reconstruct
their existing tramways
:
And whereas
it
is
expedient that the Corporation should
be
authorised
to
construct and
work
additional trainways in the
borough
and
that provisions as in this Act contained should
be
sanctioned
for
improving tramway conimunicatioii between the
korough
and adjoining districts
:

is expedient that the Corporation be authorised
to
coiistruct the street improvements and works connected

it
is expedient that further

powers
for

of
this Act be conferred upon the Corporation
:
And whereas
it
is expedient that the other provisions iii this Act
should be made
:
And whereas the objects aEoresaid cannot be effected without

of
Parliament
:
And
whereas
estimates

been prepared by the Corporation
for
the purchase
of
land for
and
the execution
of
the
various works
by
this Act authorised and such estimates are
as
follows

council at a meeting held on the first day
of
October one thousand
nine hundred after ten clear days’ notice
by
public advertisement of

of
the purpose thereof
in
the Eccles Advertiser
a
iien-spaper publislied and circulating
in
the borough (such iiotice
b&ig in addition
to
the
ordinary
notices required for suiiiinoning
siicli meeting) resolved that the expense in relation
to
promoting
the Bill for this Act should be charged
on
the
borough fund and
borough rate
of
the borough
:
And whereas
such
resolution was published twice in the said
newspaper and has received the approval
of
tlie
Local
Government
Board
:
And whereas the propriety
of
the promotion
of
the Bill for this
Act was confirmed by an absolute majority of the whole number of
the
council
at
a
further special meeting held in pursuance
of
a
similar notice
on
the seventh day of January one thousand nine
hundred and one being not less than fourteen days after the
deposit of the
Bill
in Parliament
:
And whereas the
owners
and ratepayers
of
the borough by
~.esolution
in the manner provided
in
the Third Schedule
of
the
Public
Health Act
1675
consented
to

promotion
of
the
Bill
for
this
Act
:
