[23] elwolry versus sir george reynel. Elwolry fuit en execution al suit d'un Short, & il enter en un obligation al marshal Sir George Reynel d'estre un true prisoner, & ne fair un escape. Elvvolry apres cest escape, & le marshal suer son obligation. Elwolry pleader, q,, 1'obligation fuit fait pur ease, & favour, & q^ pur cest est voyd, per 23 H. 6. Sir George Reynol reply, que 1'obligation fuit en ceux parolls, to be a true prisoner, and not to make escape. Et ne fuer ascun parols, for ease, and favour. Et le jury trove cest accordant. Et Serjeant Davenport argue pur Sir George, que 1'obligation neat voyd p 23 H. 6. quia semble a luy q^ le marshal nest un officer diens cest statute. Et il dit ouster, quand un est imprisoned est en custody del ley, est encontr son allegiance d'escaper, 3 Rep. 44 & 52 b. Et donque il dit, q^ 1'obligation est fait icy pur un chose loyal, quia un doit eatre true prisoner, g le ley, & pur c q^ 1'obligation est pur son true imprisonment, est bon.
