The Employers' Liability (Compulsory Insurance) Exemption (Amendment) Regulations 1992

Coming into force 1st July 1994
The Secretary of State in exercise of her powers under sections 3(1)(c) and 6 of the Employers' Liability (Compulsory Insurance) Act 19691and of all other powers enabling her in that behalf, hereby makes the following Regulations:—
Commencement and citation
1. These Regulations may be cited as the Employers' Liability (Compulsory Insurance) Exemption (Amendment) Regulations 1992 and shall come into force on 1st July 1994.
Amendment of the Employers' Liability (Compulsory Insurance) Exemption Regulations 1971
2. Regulation 3 of the Employers' Liability (Compulsory Insurance) Exemption Regulations 19712shall be amended as follows:—
(a) at the end of paragraph (y) for the full stop there shall be substituted a semi-colon; and
(b) after paragraph (y) there shall be inserted the following new paragraph:—
“(z)
“(z) any employer to the extent he is required to insure and maintain insurance by section 1(1) of the Act against liability for bodily injury sustained by his employee when the employee is—
(i) carried in or upon a vehicle; or
(ii) entering or getting on to, or alighting from, a vehicle,
in the circumstances specified in that subsection and where that bodily injury is caused by, or arises out of, the use by the employer of a vehicle on a road; and the expressions “road”, “use” and “vehicle” have the same meanings as in Part VI of the Road Traffic Act 1988(a).”.

These Regulations amend the Employers' Liability (Compulsory Insurance) Exemption Regulations 1971 (S.I. 1971/1933) (the 1971 Regulations). The 1971 Regulations list employers who are exempted from the requirement of the Employers' Liability (Compulsory Insurance) Act 1969 (c. 57)(the 1969 Act) to insure and maintain insurance against liability for bodily injury or disease sustained by their employees and arising out of and in the course of their employment. The exemptions listed in the 1971 Regulations are additional to those contained in section 3 of the 1969 Act.
