Whereas by subsection (3) of Section 89 of the National Insurance (Industrial Injuries) Act, 1946 it is provided that His Majesty may by Order in Council make or authorise the making of such provision as appears to Him to be necessary or expedient, having regard to the provisions of that section for modifying, in relation to employers' liability insurance business, the Assurance Companies Act, 1909, or any Act passed before the appointed day amending that Act; and

Whereas by the National Insurance (Industrial Injuries) Act, 1946 (Appointed Day) Order, 1948(a), it was ordered that the said appointed day should be the fifth day of July, 1948:

Now therefore His Majesty, in pursuance of the said subsection and of all other powers enabling Him in that behalf is pleased, by and with the advice of His Privy Council to order, and it is hereby ordered, as follows:

1. In the case of an assurance company which carries on employers' liability insurance business and any other class of assurance business to which the Assurance Companies Acts, 1909 to 1946 (hereinafter called "the Acts"), apply the employers' liability insurance business need not, in respect of any financial year of the company commencing after the 30th November, 1947, be treated as a class of business to which the Acts apply, and the said company shall not, in relation to that business be bound by the provisions of the Acts.

2. Save as hereinafter provided nothing in the foregoing paragraph shall be taken to exempt from any of the provisions of the Acts an assurance company which carries on employers' liability insurance business and no other assurance business to which the Acts apply; but such an...
