The Secretary of State, in exercise of the powers conferred upon him by sections 3 and 11 of the Endangered Species (Import and Export) Act 1976(a) and of all other powers enabling him in that behalf, after consulting a scientific authority, hereby makes the following order:—
Citation and commencement
1. This order may be cited as the Endangered Species (Import and Export) Act 1976 (Modification) Order 1983 and shall come into operation on 26th November 1983.
Interpretation
2. In this order—
"the Act" means the Endangered Species (Import and Export) Act 1976; and
"Schedule 3" means Schedule 3 to the Act as modified by the Endangered Species (Import and Export) Act 1976 (Modification) Order 1982(b).
Modification of Schedule 3 to the Act
3. Schedule 3 shall be further modified in accordance with article 4 of this order.
4.—(1) In paragraph 11(5)(d) of Schedule 3 there shall be added in the appropriate places in alphabetical order the following—
"Cystophora cristata (hooded seal)", and
"Phoca (Pagophilus) groenlandica (harp seal)".

(2) The modifications of Schedule 3 made by paragraph (1) above shall cease to have effect on 1st October 1985.

EXPLANATORY NOTE
(This Note is not part of the Order.)
This order modifies Schedule 3 to the Endangered Species (Import and Export) Act 1976 by including in it animals of the species hooded seal and harp seal. (These modifications will cease to have effect on 1st October 1985.) They are included in the Schedule as defined animals for the purpose of prohibiting (except under licence) the importation and exportation of certain specified parts and products of such animals in order to promote their conservation. Schedule 3 was previously modified by S.I. 1982/1230.
The order gives effect to Council Directive No. 83/129/EEC (concerning importation of skins of certain seal pups and products derived therefrom). Copies of the Official Journal of the European Communities dated 9th April 1983 containing the EEC Directive may be obtained from Her Majesty's Stationery Office.
