APPEAL UNDER REGULATION 29 OF THE RAILWAYS
INFRASTRUCTURE (ACCESS AND MANAGEMENT) REGULATIONS 2005
– RAIL FREIGHT CHARGING SYSTEM AND LEVEL OF ACCESS
CHARGES FOR THE HIGH SPEED 1 RAILWAY
1. I refer to your letter of 25 March 2008 regarding an appeal by English Welsh &
Scottish Railway Limited (EWS) to the Office of Rail Regulation (ORR) pursuant to
Regulation 29 of the Railways Infrastructure (Access and Management) Regulations
2005 (the Regulations) and my subsequent acknowledgement of 1 April 2008.
2. We note the concerns raised by EWS in its letter and, as a first step in the appeals
process, we are now considering the basis of this appeal. In order to do this, we
require further explanation and clarity in relation to the grounds upon which EWS’
appeal is based. In particular, will you please confirm which of the matters set out
under Regulation 29(2) of the Regulations your appeal concerns.
3. In addition, I draw your attention to Paragraph 4.5 of our document “Guidance on
Appeals to ORR under the Regulations – March 20061” which states: “As we intend to
base our determination only upon information presented by the parties, it is, therefore,
very important that the application contains all the relevant details and supporting
information”. With this in mind, you may wish to consider whether there is any further
information you think should be presented to us when you respond to this letter.
