The Export of Goods (Control) (Serbia and Montenegro Sanctions) Order 1992

The Secretary of State, in exercise of powers conferred by secton 1 of the Import, Export and Customs Powers (Defence) Act 19391and now vested in him2, and of all other powers enabling him in that behalf, hereby makes the following Order:—

S-1 Citation, commencement and interpretation

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Export of Goods (Control) (Serbia and Montenegro Sanctions) Order 1992 and shall come into force forthwith.

(2) Unless the context otherwise requires, any expression used in this Order shall have the meaning it bears in the Export of Goods (Control) Order 19913.

S-2 Prohibition on exportation to Serbia and Montenegro

2.—(1) Subject to article 3 of this Order, all goods are prohibited to be exported from the United Kingdom to any destination in Serbia or Montenegro or to any destination in any other country for delivery, directly or indirectly, to a person for the purposes of any business carried on in or operated from either of those territories.

(2) Any licence granted by the Secretary of State under any other Order relating to the control of exports made by virtue of the powers conferred by section 1 of the Import, Export and Customs Powers (Defence) Act 1939, and any licence granted under any other enactment prohibiting or restricting the exportation of goods, shall be subject to paragraph (1) of this article.

3. Nothing in article 2 of this Order shall prohibit the exportation of any goods under the authority of a licence granted by the Secretary of State under this Order, provided that all conditions attaching to the said licence are complied with.

S-4 Enforcement

4. Articles 5, 6 and 7 of the Export of Goods (Control) Order 1991 (customs powers for demanding evidence of destination, offences in connection with applications for licences and conditions attaching to licences, and declarations as to goods and powers of search) shall apply for the enforcement of the provisions of this Order as they apply for the enforcement of the said Order of 1991.
