The Federation of Malaya (Amendment) Order in Council, 1954

The Queen's Most Excellent Majesty in Council

Her Majesty, by virtue and in exercise of the powers vested in Her by the Straits Settlements (Repeal) Act, 1946(a), and the British Settlements Acts, 1887(b) and 1945(c), or otherwise in Her Majesty vested, is pleased by and with the consent of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation, construction and commencement

1.—(1) This Order may be cited as the Federation of Malaya (Amendment) Order in Council, 1954, and shall be construed as one with the Federation of Malaya Order in Council, 1948(d) (hereinafter referred to as "the principal Order").

(2) The principal Order and this Order may be cited together as the Federation of Malaya Orders in Council, 1948 and 1954.

(3) This Order shall come into operation in relation to a Settlement on such date as the High Commissioner may, by notification in the Gazette, appoint for that Settlement; and the High Commissioner may so appoint different dates for different provisions of this Order:

Provided that any date so appointed shall not be earlier than the day after the day upon which this Order shall have been laid before both Houses of Parliament.*

Amendment of section 2 of the principal Order

2. Section 2 of the principal Order shall be amended as follows:

(a) in sub-section (1)—

(i) the definition of "Federal Citizen" shall be deleted; and

(ii) the following three definitions shall be inserted immediately after the definition of "the appointed day"—

'"citizen of the Federation of Malaya" means a person who is a citizen of the Federation of Malaya by virtue of the provisions of Part XII of the Federation Agreement;'

'"the Colony" means the Colony of Singapore;'

* Date appointed for ss. 3, 4, 14.10.54; for remaining provisions in respect of Penang, 10.1.55.

No date yet (June, 1955) appointed for remaining provisions in respect of Malacca.

'"the Commonwealth" means collectively the United Kingdom and any other part of Her Majesty's dominions, India, any territory under Her Majesty's protection and any territory administered by the government of any part of Her Majesty's dominions in accordance with a mandate from the League of Nations or under the trusteeship system of the United Nations:';

(b) immediately after sub-section (1) there shall be inserted the following sub-section:

"(1A) For the purposes of this Order a person shall be deemed to have reached a specified age when he has, since his birth, completed that number of years of life reckoned in accordance with the Gregorian calendar.";

(c) in paragraph (b) of sub-section (4) for the words "shall not be" there shall be substituted the words "shall or shall not be deemed to be".

Amendment of section 12 of the principal Order.

3. In paragraph (a) of subsection (2) of section 12 of the principal Order the word "four" shall be substituted for the word "three", and the words and comma "the Settlement Secretary," shall be inserted immediately after the words and comma "the Resident Commissioner,".

Amendment of section 18 of the principal Order

4. In paragraph (b) of section 18 of the principal Order the word "three" shall be substituted for the word "two" and the words and comma "the Settlement Secretary," shall be inserted immediately after the word "namely".

Replacement of section 21 of the principal Order

5. Section 21 of the principal Order shall be revoked and the following new section shall be substituted therefor:
