ENVIRONMENTAL PROTECTION

The Financial Assistance (Sewerage Improvements) (Scotland) Order 1991

Coming into force 1st March 1991

The Secretary of State, in exercise of the powers conferred on him by section 153(4) of the Environmental Protection Act 19901and of all other powers enabling him in that behalf, hereby makes the following Order:

S-1 This Order may be cited as the Financial Assistance (Sewerage...

1. This Order may be cited as the Financial Assistance (Sewerage Improvements) (Scotland) Order 1991, shall come into force on 1st March 1991 and shall extend to Scotland only.

S-2 Section 153(1) of the Environmental Protection Act 1990 shall...

2. Section 153(1) of the Environmental Protection Act 1990 shall be varied by the addition of the following subparagraph:—

“(n)

“(n) the programmes of regional and islands councils in Scotland, as local authorities exercising functions under the Sewerage (Scotland) Act 19682, for the carrying out of works to improve the quality of inland, coastal and relevant territorial waters, as defined in section 30A of the Control of Pollution Act 19743, or otherwise to benefit the environment.”.

This Order enables the Secretary of State, with the consent of the Treasury, to give financial assistance under section 153 of the Environmental Protection Act 1990 to regional and islands councils in Scotland in respect of their Sewerage improvements programmes.
