[21] FOTHERtYES CASK. Prohibition, Ordinary, Distribution, Biens de Intestate. Nicholas Fotherly fuit seisie del Copihold terre al value da 401. per annum, & surrender ceo al use del feme pur vie, & apres devye possesse del bieus al value de 200 1. Et Anne son feme prist Adrainistracon. Mary Fotherlie soer del Intestate eeant le heire, sur que le Copybould descend en reversion, sue in Court del Ordinary pur faire distribution des biens, & le Ordinary assigne 20 1. a luy. Et Anne pria pro-hibicon. Finch Recorder, devaut le statute de 21 E. 3, cap. 11. Le Ordinary puist faire distribution sans question, & le statute ne deprive luy de son poiar. Et in temps del Snor Hubbard, quant un Prohibicou fuit desire in cest case apres several Arguments le Court advise le Administrator al submitter al clistribucon, & pur ceo que le matter icy est petit, jeo conceive que vous ne voile grauuter un Prohibicon, & auxi le Guatome de cest Court est, nemy a graunter Prohibicon aprea decree on sentence done, &c.
