The Minister of Fuel and Power in exercise of the powers conferred upon him by section fifty-eight of the Gas Act, 1948(a), and of all other powers him enabling hereby makes the following regulations:—
1. The Gas (Pension Scheme) Regulations, 1949(b), shall have effect subject to the modification that regulation one thereof (which authorises the establishment of pension schemes by Area Boards and the Gas Council) shall be deemed to be paragraph (1) of regulation one and that the following paragraph shall be inserted after the said paragraph (1):—
"(2) For the purposes of any such pension scheme as aforesaid, the service of any person as a whole-time member of an Area Board or the Gas Council may be treated as if it were service in the employment of the said Board or Council, if that person—
(a) was subject to the scheme in question immediately before becoming such a member;
(b) was then subject to another such scheme, and within six months thereof agrees with the managers of the scheme in question and with the managers of that other scheme that an appropriate payment shall be made by way of transfer value in respect of him, and that, in lieu of being subject to the other scheme, he shall become subject to the scheme in question; or
(c) is, by virtue of the Act and any regulations relating to pension rights made by the Minister under section fifty-eight thereof, subject to another pension scheme, or entitled to rights, in relation to any Area Board or the Gas Council and agrees with the said Board or Council that in lieu thereof he shall become subject to the scheme in question."
2.—(1) These regulations may be cited as the Gas (Pension Scheme) (Amendment) Regulations, 1950.
(2) These regulations shall come into operation on the fifteenth day of May, nineteen hundred and fifty, but shall then be deemed to have had effect from the twenty-third day of April, nineteen hundred and forty-nine.
