Whereas in pursuance of section 5(2) of the Opticians Act 19891the General Optical Council have made the Disciplinary Committee (Constitution) Rules 1998 as set out in the Schedule to this Order:

And whereas by section 34 of the said Act such rules shall not come into force until approved by order of the Privy Council:

Now, therefore, Their Lordships, having taken the said rules into consideration, are hereby pleased to approve the same.

The General Optical Council (Disciplinary Committee Rules) Order of Council 19602, the General Optical Council (Disciplinary Committee Rules) (Amendment) Order of Council 19713and the General Optical Council (Disciplinary Committee Rules) Order of Council 19844are hereby revoked.

This Order may be cited as the General Optical Council (Disciplinary Committee (Constitution) Rules) Order of Council 1998, and shall come into force on 10th June 1998.

SCHEDULE

GENERAL OPTICAL COUNCIL

The Disciplinary Committee (Constitution) Rules 1998

The General Optical Council, in exercise of their powers under section 5(2) of the Opticians Act 19895, hereby make the following Rules:

SCH-1.1

1. These Rules may be cited as the Disciplinary Committee (Constitution) Rules 1998.

SCH-1.2

2. In these Rules “the Act” means the Opticians Act 1989 and “the Schedule” means Schedule 1 to the Act; “the Committee” means the Disciplinary Committee whose existence is continued under section 5 of the Act. A registered optician shall be deemed to be resident at the address entered in the appropriate register kept by the Council under the Act as his permanent address.

SCH-1.3

3. The Committee shall consist of fifteen members of the Council appointed by the Council in accordance with the requirements of these Rules.

SCH-1.4

4. The Chairman of the Committee shall be appointed from among the members of the Council nominated under sub-paragraph (a) of paragraph 1 of the Schedule.

SCH-1.5

5. Two members of the Committee additional to the Chairman shall be appointed from among the members of the Council nominated under sub-paragraph (a) of paragraph 1 of the Schedule.

SCH-1.6

6. Two members of the Committee shall be appointed from among the registered medical practitioners referred to in sub-paragraph (e) of paragraph 1 of the Schedule.

SCH-1.7

7. Four members of the Committee shall be appointed from among the members of the Council chosen to represent registered ophthalmic opticians under sub-paragraph (b) of paragraph 1 of the Schedule and the members nominated by the British College of Optometrists under sub-paragraph (d) of that paragraph.

SCH-1.8

8. Three members of the Committee shall be appointed from among the members of the Council chosen to represent registered dispensing opticians under sub-paragraph (c) of paragraph 1 of the Schedule and the members nominated by the Association of British Dispensing Opticians under sub-paragraph (d) of that paragraph.
