CHAPTER ccxxxii.
An Act for conferring further powers upon the Great
A.D.
1896.
"Western Railway Company in respect of their own
undertaking and upon that Company and the Midland
Railway Company and the London and North Western
Railway Company in respect of undertakings in which
they are jointly interested for amalgamating the
Abbotsbury Much Wenlock and Severn Junction
Marlborough Milford Wenlock Vale of Llangollen
Llangollen and Corwen and Corwen and Bala Railway
Companies with the Great Western Railway Company
and for other purposes. [7th August 1896.]

HEREAS it is expedient that the Great Western Railway
Company (in this Act called " the Company") should be
empowered to execute make and maintain the railway and other
works and to exercise the powers by this Act respectively authorised
and conferred upon them and to acquire for the purposes of this
Act and for the general purposes of their undertaking and works
connected therewith and for providing increased accommodation
•certain lands houses and buildings in this Act described or
ref erred to:
And whereas it is expedient that the Company and the Midland
Railway Company (in this Act called " the Midland Company")
should be empowered to make and maintain the railway in the
Forest of Dean by this Act authorised to be made by them and
that the said Companies and the Commissioners of Woods should
be empowered to enter into and carry into effect agreements with
reference thereto as provided by this Act:
And whereas it is expedient that the Company and the London
and North Western Railway Company (in this Act called "the
North Western Company ") should be empowered to acquire the
lands in this Act mentioned or referred to in that
behalf:

1896. And whereas plans and sections showing the lines and levels of
the railway and other works by this Act authorised to be constructed
and plans showing the lands by this Act authorised to be acquired
and also books of reference containing the names of the owners and
lessees or reputed owners and lessees and of the occupiers of those
lands were duly deposited with the clerks of the peace for the
several counties within which such railway and other works will
be constructed and those lands are situated and are herein-after
respectively referred to as the deposited plans sections and books
of reference:
And whereas the respective undertakings of the Abbotsbury and
the Much Wenlock and Severn Junction Eailway Companies are
under the authority of Parliament leased to or worked by the
Company and it is expedient that they should be transferred to and
vested in the Company and that the respective agreements with
reference thereto which are sec forth in the Third and Fourth
Schedules to this Act should be confirmed :
And whereas the undertakings of the Marlborough the Milford
the Wenlock the Vale of Llangollen the Llangollen and Corwen and
the Corwen and Bala Eailway Companies are under the authority
of Parliament leased to or worked by the Company :
And whereas the Fifth Schedule to this Act contains in the first
three columns thereof a statement of the particular's of the capitals
issued by the said companies respectively:
And whereas the Company have subscribed for and now hold by
themselves or their nominees the shares and stocks of some of the
said companies as stated in the fourth column of the said schedule
and it is expedient that the said companies should be amalgamated
vrith the Company in the manner provided by this Act :
And whereas it is expedient that some of the provisions of
existing Acts of the Company should be amended or repealed as
herein-after provided:
And whereas it is expedient that the Company should be
authorised to raise an additional sum of money and to apply their
funds for the purposes of this Act and for the general purposes of
their undertaking:
And whereas it is expedient that the Midland Company and the
North Western Company should respectively be empowered to apply
their funds as provided by this Act:
And whereas the objects aforesaid cannot be attained without the
authority of Parliament:
May it therefore please Your Majesty that it may be enacted and
be it enacted by the Queen's most Excellent Majesty by and with

the advice and consent of the Lords Spiritual and Temporal and. A.D.1896.
Commons in this present Parliament assembled and by the authority
of the same as follows :

This Act may be cited for all purposes as the Great Western Short title.
Railway (Additional Powers) Act 1896.
2.
The following Acts and parts of Acts are except, where Ineorpora-
expressly varied by this Act incorporated with and form part of tion of
this Act (that is to say):- ^ generally
The Lands Clauses Acts :
The Railways Clauses Consolidation Act 1845 :
Part I. (relating to the construction of a railway) and ...Part V.
(relating to amalgamation) of the Railways Clauses Act. 1863 :
The provisions of the Companies Clauses Consolidation Act 1845
with respect to the following matters (namely) :
The distribution of the capital of the Company into shares;
The transfer or transmission of shares;
The payment of subscriptions and the means of enforcing
the payment of calls;
The forfeiture of shares for non-payment of calls ;
The remedies- of creditors of the Company against the
shareholders;
The borrowing of money ;
The conversion of the borrowed money into capital;
The consolidation of shares into stock ; and
The provision to be made for affording aceess to the special
Act by all parties interested :
And Part I. (relating to cancellation and surrender of shares)
Part II. (relating to additional capital) and Part III. (relating
to debenture stock) of the Companies Clauses Act 1863.

In this Act the several words and expressions to which Interpreta-
meanings are assigned by the Acts wholly or partially incorporated tl0n-
herewith have the same respective meanings unless there be some-
thing in the subject or context repugnant to such construction:
The expression "the railway" means the new railway by this
Act authorised to be made by the Company :
The expression " the Two Companies " means and includes the
Company and the Midland Company or whichever of those
Companies exercises the powers by this Act conferred upon
the Two Companies:
The expression " the Abbotsbury Company " means the Abbots-
bury Railway Company:
The expression "the Much Wenlock Company " means the Much
Wenlock and Severn Junction Railway Company:
