The Greater Manchester (Light Rapid Transit System) (Airport Extension Order 1997) (Moor Road Modification) Order 1999

Coming into force 18th February 1999

Whereas an application has been made to the Secretary of State for the Environment, Transport and the Regions (“the Secretary of State”), in accordance with the Transport and Works (Applications and Objections Procedure) Rules 19921made under sections 6, 7 and 10 of the Transport and Works Act 19922(“the Act”), for an Order under sections 1 and 5 of the Act;

And whereas the objections to that application have been withdrawn;

And whereas the Secretary of State, has determined to make an Order giving effect to the proposals comprised in the application with modifications which in his opinion do not make any substantial change in the proposals;

And whereas notice of the Secretary of State’s determination was published in the London Gazette on 11th January 1999;

Now, therefore, the Secretary of State, in exercise of the powers conferred by sections 1 and 5 of, and paragraphs 1 to 4, 6 to 13 and 15 to 17 of Schedule 1 to the Act and of all other powers enabling him in that behalf, hereby makes the following Order:–

S-1 Citation and commencement

1. This Order may be cited as the Greater Manchester (Light Rapid Transit System) (Airport Extension Order 1997) (Moor Road Modification) Order 1999 and shall come into force on 18th February 1999.

S-2 Interpretation

Interpretation

2. In this Order–

“the 1997 Order” means the Greater Manchester (Light Rapid Transit System) (Airport Extension) Order 19973; and

“authorised street tramway”, “the scheduled works”, “street tramway” and “the undertaker” have the same meaning as in the 1997 Order.

S-3 Modification of Works

Modification of Works

3.—(1) The undertaker may construct and maintain Work No. 10A as specified in the Schedule to this Order in lieu of a part of Works Nos. 10 and 11 authorised by the 1997 Order (being the part of Work No. 10 40 metres in length and the part of Work No. 11 88 metres in length extending in each case from the junction of those works) and may construct and maintain the remainder of Works Nos. 10 and 11 authorised by the 1997 Order so as to form a junction with the commencement and termination of Work No. 10A respectively.

(2) The 1997 Order shall have effect as if–
