[314] 391. greenwood versus tyler. Tr. 16 Jac, B. R. Rot. 1089. Error. Now this term, Mich. 18 Jacobi, by a writ of error out of the King's Bench, came this cause before us. Robert Greenwood brought an ejectione firmas against John Tyler, of lands in Box in the said county; and upon issue not guilty, a special verdict HOBAM.S15. GREENWOOD V. TYLER 457 was found, que Anthonie Long & Alice sa femme fueront seisie in fee, in droit Alice del dits tenements in que &c. & sic seisit. 20 Aug. anno 2 E. 6. un indenture fuit feit enter le dit Anthony Long, & Alice sa femme del un part & un John Fisher del auter part per que les dits Anthony Long & Alice sa femme demise & lease al fartne per indenture al dit John Fisher & Anne sa femme & Johanne lour file les dits tenements in le count mentioned. Habend. les dits tenements al John Fisher & Anne sa femme & Johan lour file & eorum diutius viven. successive a Festo S. Michaelis Archangeli, donque prochein ensuant le date del dit indenture usque le fine & terme de lour vies naturall, rendant proinde annuatim durant. vitis suis ut prtedict. est le yearly rent de 13s. 4d. ovesque un harriot de lour best animal post eorum decessum sive exitum, Anglice going out cujuslihet eorum : ove covenant de part John Fisher & sa femme & Johanne lour file de payer touts free rents & autres charges and duties issuant hors de ceste terre durant lour vies ut profertur apres le Feast de S.
