In an action of debt on bond, attested by one witness only, plaintiff had been nonsuited on non est factum pleaded, the witness not making sufficient proof of the execution of the bond. Plaintiff brought a new action on the same bond : defendant BABHE8.74. BAIL, ETC. 813 moved for a common appearance, and obtained a rule to shew cause, which was discharged on hearing counsel on both sides. Note ; defendant did not in his affidavit deny the execution of the bond. Eyre and Wynne for defendant; Chappie for plaintiff quoted Chambers...
