912 PASCH. 24 CAR. BANCO REGIS A1BYN. 53. hart verms buckminster. hil. 23 car. eot. 225. Debt. In an action of debt upon a bond with condition, reciting, that whereas the plaintiff had carried 12000 billets for the defendant to Dartmouth, if the defendant should pay the plaintiff after the rate of 17s. per 1000. then the obligation should be void; the defendant upon oyer thereof pleaded, that the plaintiff did not carry 12000 billets to Dartmouth; and upon demurrer judgment was given for the plaintiff, for the defendant is estopped to deny it.
