Ejectione firme del manner de Feifield, & declare sur un demise p Dr. Steward del mannor de Feifield, & monstre un ejectment del mannour, & le jury trove le defendant non eulp. quoad messuag. curtilag. parcel maner pdicf. Le ejectment fuit port f baron, & feme, & le feme solement trove culp. & unc bien, qui a si ascun trove culp. est suffic. Mea fuit move en arrest del judgment, quia 1'ejection firm fuifc port d'un maner, & le defendant plead non culp. & le jury trove luy culp. quoadum messuag. unum curtilag. & pur resid non culp. Issint que ils sont trove culp. forsque de parcel maner, & 1'action est de maner solement, & nemy de ascun acres. Mes si ejection firm ad estre port des tant des [62] acres del maner, & le defendant ad estre trove eulp de aseun del acres c ad estre uii bon verdict sur quel judgment poet estre bien done; mes quand le demand est d'un maner si ne soit tiel rnaner il ne poet estre culp de tiel maner. Le demandant done en evidence, q^ le tenant ad enter en les òdemesnes del mannour, & mit luy hors; et le counsel del tenant mitter le demandant de prover, que il fuit un maner, & 4^ le tenant avoit attournement des tenants, quia sans tenants ne poet eatre un maner ; & le demandant faylont de prover c un mannour fuit nonsue. Et p Finch Recorder de London que move en arrest del judgment; ceo case fuit mise in ejection firm del rectory, & non culp plead, fuit done en evidence, c^ le defendant prist les dismes, mes le plaintiff ne poyt prover, q^ le defendant enter en les gleabe terrs, & fuit resolve, q^ prisel des dismes ne fuit ascun ejectment del rectory, & p c le plaintiff fuit nonsue. Et icy quand est dit, q, n'est hide culp c est d'un maner, & nemy d'un messuage, ou curtillage. Noy ils ont trove luy culp de un messuage, & curtillage parcel de maner avandit. Et est un grand difference inter un breve d'entry sur disseisin, & un ejectione firme, en Tun terre est demand, en Tauter forsque per consequence recover.
