Friday, June 22cl, 1810.-Where an affidavit has been sworn before the plaintiffs solicitor, it is necessary to have an affidavit of that fact; the Court will not reject it, merely because it appears on the face of it to have been sworn before a person of the same name as the plaintiff's attorney. Hughes objected to an affidavit put in by the plaintiff', in opposing the justification of the defendant's bail, that it was sworn before the plaintiff's solicitor.
