The Minister of Agriculture, Fisheries and Food and the Secretary of State concerned with the sea fishing industry in Scotland, in exercise of the powers conferred upon them by section 1 of the Sea Fish (Conservation) Act 1967(a) as amended by section 16 of the Sea Fisheries Act 1968(b) and of all other powers enabling them in that behalf, hereby make the following Order:—

1. This Order may be cited as the Immature Crabs and Lobsters Order 1976 and shall come into operation on 15th March 1976.

2. The Interpretation Act 1889(c) shall apply to the interpretation of this Order as it applies to the interpretation of an Act of Parliament, and as if this Order and the Order hereby revoked were Acts of Parliament.

3. The Sea-Fishing Industry (Crabs and Lobsters) Order 1966(d) is hereby revoked.

4. For the purposes of section 1(1) of the Sea Fish (Conservation) Act 1967 (which prohibits in Great Britain the landing, sale, exposure or offering for sale or the possession for the purpose of sale of any sea fish of any description, being a fish of a smaller size than such size as may be prescribed in relation to sea fish of that description) the following sizes are hereby prescribed:—

(a) in relation to crabs of the species Cancer pagarus, a width of 115 millimetres across the broadest part of the back;

(b) in relation to lobsters, a carapace length of 80 millimetres, being the length measured from the rear of either eye socket to the rear end of the body shell along a line parallel to the centre line of the body shell.

5. There shall not be carried in any foreign fishing boat in waters adjacent to the United Kingdom and within the fishery limits of the British Islands

any crab or lobster which is of less than the minimum size prescribed in relation thereto by article 4 of this Order.
