The Import and Export (Plant Health) (Great Britain) (Amendment) Order 1985

The Minister of Agriculture, Fisheries and Food in relation to England, the Secretary of State for Scotland in relation to Scotland and the Secretary of State for Wales in relation to Wales, in exercise of the powers conferred by sections 2 and 3(1), (2) and (4) of the Plant Health Act 1967(a), and now vested in them(b), and of every other power enabling them in that behalf, hereby make the following order:—

Title, extent and commencement

1. This order may be cited as the Import and Export (Plant Health) (Great Britain) (Amendment) Order 1985, shall apply to Great Britain and shall come into operation on 30th June 1985.

Amendment of principal order

2. The Import and Export (Plant Health) (Great Britain) Order 1980(c) shall be amended as follows:—

(1) For paragraph (f) of Article 5 (prohibition of the landing of certain plants etc) there shall be substituted the following paragraph:—

"(f) any plant of beet (Beta vulgaris L.) other than

(i) seeds of red beet or beetroot, spinach beet, leaf beet or chard specified in column 2 of Part IVE of Schedule 2;

(ii) plants of red beet or beetroot, spinach beet, leaf beet or chard for consumption as food;

(iii) seeds of genetically monogerm varieties which have been cleaned free from soil and other debris and have been rubbed or ground to remove the outer layers of the perianth and graded to between 3.00 mm and 4.50 mm."

(2) Immediately after "1VB" in paragraph (1) of Article 7 and immediately after "1VC" in paragraph (1) of Article 8 there shall be inserted "1VE".

(a) 1967 c. 8; sections 2(1), 3(1) and (2) were amended by the European Communities Act 1972 (c. 68), section 4(1) and Schedule 4, paragraph 8.

(b) In the case of the Secretary of State for Wales by virtue of S.I. 1978/272.

(c) S.I. 1980/420; the relevant amending instrument is S.I. 1984/839.

(3) For paragraph (2) of Article 17 there shall be substituted the following paragraph;

"(2) An application for a licence to land any plant of beet (Beta vulgaris L.) in Great Britain, notwithstanding the provisions of this order, shall be refused only if the appropriate Minister considers that refusal is necessary for the purpose of preventing the introduction into, or the spread in, Great Britain of Rhizomania disease caused by beet necrotic yellow vein virus, and the conditions imposed by such a licence...
