THE INCREASE OF CONTRIBUTORY PENSIONS REGULATIONS, 1946.

THE NATIONAL INSURANCE (INCREASE OF CONTRIBUTORY PENSIONS) REGULATIONS, 1946, DATED SEPTEMBER 10, 1946, MADE BY THE MINISTER OF NATIONAL INSURANCE, IN CONJUNCTION WITH THE TREASURY UNDER THE NATIONAL INSURANCE ACT, 1946 (9 & 10 GEO. 6. C. 67.

The Minister of National Insurance, acting in conjunction with the Treasury, in exercise of the powers conferred by section 69 of the National Insurance Act, 1946, and of all other powers enabling him in that behalf, hereby makes the following regulations:—

Citation and interpretation.

1.—(1) These regulations may be cited as the National Insurance (Increase of Contributory Pensions) Regulations, 1946.

(2) In these regulations, unless the context otherwise requires, the following expressions have the meanings hereby respectively assigned to them:—

"the Minister" means the Minister of National Insurance;

"the Contributory Pensions Acts" means the Widows', Orphans' and Old Age Contributory Pensions Acts, 1936 to 1941, as amended by any subsequent enactment or regulations;

"the Contributory Pensions Act of 1936" means the Widows', Orphans' and Old Age Contributory Pensions Act, 1936, as amended by any subsequent enactment or regulations;

"the Contributory Pensions Act of 1937" means the Widows', Orphans' and Old Age Contributory Pensions (Voluntary Contributors) Act, 1937, as amended by any subsequent enactment or regulations;

2 & 3 Geo. 6. c. 84.

"the Contributory Pensions Act of 1939" means the National Health Insurance and Contributory Pensions (Emergency Provisions) Act, 1939, as amended by any subsequent enactment or regulations;

"the Modification Regulations" means the Contributory Pensions (Modification of Old Age Pensions) Regulations, 1939(a), as amended(b);

"the Consequential Amendments Regulations" means the National Health Insurance and Contributory Pensions (Consequential Amendments) Regulations, 1942(b);

"pension" does not include an additional allowance payable under the provisions of the Contributory Pensions Acts.

(3) The Interpretation Act, 1889, applies to the interpretation of these regulations as it applies to the interpretation of an Act of Parliament.

(4) These regulations do not apply to Northern Ireland.

Increase in rates of pension contributions.

2.—(1) For the purpose of making provision towards the cost of the increase in rates of pensions provided by these regulations, the rates of contributions specified in the First Schedule to the Contributory Pensions Act of 1936, as amended(c), shall, as from the 30th September, 1946, be increased by submitting the First Schedule to these regulations for that schedule.

(2) For the purpose aforesaid, the sum of two shillings shall, as from the 30th September, 1946, be substituted for the sum of elevenpence specified in subsection (1) of section 20 of the Contributory Pensions Act of 1936, as amended(d) (which relates to contributions payable under that Act in respect of short service constables of the metropolitan police force).

(3) For the purpose aforesaid, the provisions of the Contributory Pensions Act of 1937 relating to rates of contributions payable by special voluntary contributors shall, as from the 30th September, 1946, be modified by substituting the following provisions and the Second Schedule to these regulations for subsections (2) and (3) of section 4 of, and the Second Schedule to, the said Act:—

"(2) The contributions so payable by special voluntary contributors (other than contributors insured for the purpose of widows' pensions and orphans' pensions only) shall be—

(a) in the case of initial entrants, at the rate of three shillings and one penny a week in the case of a man, and sixpence a week in the case of a woman;

(c) S. 41, Widows', Orphans' and Old Age Contributory Pensions Act, 1936; ss. 13 (2) and 20 (3), Fifth and Sixth Schs., Widows', Orphans' and Old Age Contributory Pensions (Voluntary Contributors) Act, 1937; S. 1 (3) and First Sch., Old Age and Widows' Pensions Act, 1940 (3 & 4 Geo. 6. c. 13); and s. 2 and Second Sch., National Health Insurance, Contributory Pensions and Workmen's Compensation Act, 1941 (4 & 5 Geo. 6. c. 39).

(d) S. 1 (3) and First Sch., Old Age and Widows' Pensions Act, 1940.

(b) in the case of all other special voluntary contributors of that class, at the rate of three shillings and one penny a week in the case of a man, and, in the case of women, at the rates specified in the Second Schedule to this Act, being rates calculated by reference to age at the date of entry into insurance.

(3) The contributions so payable by special voluntary contributors who are insured for the purpose of widows' pensions and orphans' pensions only shall be—

(a) in the case of initial entrants, at the rate of one shilling and fivepence a week; and

(b) in the case of all other special voluntary contributors of that class, at the rate of one shilling and eightpence a week."

Increase in standard rate of old age pension where pension is in respect of pensioner's own insurance.

3. Subject to the provisions of these regulations, where a person is on the 30th September, 1946, entitled, or thereafter becomes entitled, in respect of his or her own insurance, to an old age pension under the Contributory Pensions Acts or the Modification Regulations at the standard rate of ten shillings a week, that rate shall be increased to twenty-six shillings, if and when those of the following conditions which are applicable in his or her case are satisfied:—

(1) In the case of a man, he must either—

(a) have retired from regular employment in accordance with regulation 10; or

(b) have attained the age of seventy;

(2) In the case of a woman, she must either—

(a) have so retired from regular employment; or

(b) have attained the age of sixty-five.

Increase in standard rate of old age pension for a woman where pension is in respect of husband's insurance.

4. Subject to the provisions of these regulations, where a woman (not being a woman to whom regulation 3 applies) is on the 30th September, 1946, entitled, or thereafter becomes entitled, in respect of the insurance of her husband, to an old age pension under the Contributory Pensions Acts or the Modification Regulations at the standard rate of ten shillings a week, that rate shall be increased to sixteen shillings, if and when those of the following conditions which are applicable in her case are satisfied:—

(1) If she has attained the age of sixty-five, her husband must either—

(a) have retired from regular employment in accordance with regulation 10; or

(b) have attained the age of seventy;

(2) If she has not attained the age of sixty-five, in addition to her husband satisfying the appropriate condition specified in paragraph (1) of this regulation, she must herself have so retired from regular employment.

Increase in standard rate of widows' pensions.

5. Subject to the provisions of these regulations, where a woman is on the 30th September, 1946, entitled, or thereafter becomes entitled, to a widow's pension under the Contributory Pensions Acts at the standard rate of ten shillings a week, that rate shall be increased to twenty-six shillings, if and when the following conditions are satisfied:—

(1) She must have attained the age of sixty; and

(2) She must either—

(a) have retired from regular employment in accordance with regulation 10; or

(b) have attained the age of sixty-five.

Increase in rates of old age and widows' pensions payable at less than the standard rate.

6.—(1) Subject to the provisions of these regulations, where a person is on the 30th September, 1946, entitled, or thereafter becomes entitled, to an old age pension or widow's pension under the Contributory Pensions Acts or any regulations made thereunder, at a rate which is less than the standard rate of ten shillings a week, the rate of that pension shall be increased to the appropriate rate referred to in paragraph (2) or (3) of this regulation, if and when those of the conditions referred to below which are applicable in his or her case are satisfied:—

(a) If the pension is an old age pension in respect of the pensioner's own insurance, the pensioner must satisfy the appropriate conditions specified in paragraph (1) or (2) of regulation 3;

(b) If the pension is an old age pension in respect of the insurance of the pensioner's husband, the appropriate conditions specified in paragraph (1) or (2) of regulation 4 must be satisfied;

(c) If the pension is a widow's pension, the pensioner must satisfy the appropriate conditions specified in paragraphs (1) and (2) of regulation 5.

(2) Subject to the provisions of paragraph (3) of this regulation, where a person who satisfies the appropriate provisions of paragraph (1) of this regulation is, or becomes, entitled to a pension at less than the standard rate of ten shillings a week under the Contributory Pensions Acts(a) or any regulations made thereunder(b) (other than under paragraph (b) of subsection (3) of section 14 of the Contributory Pensions Act of 1939, which subsection provides for modified old age pensions where certain dependants war pensions are payable), that is to say, to a pension at one of the rates specified in the first column of the Third Schedule, that rate shall be increased to the rate, appropriate to the circumstances of the case, specified in the second or third column of that schedule.
