[568] jeenegan v. baxter. Dec. 10, 1832. Representation. Semble, that where a testator's will is proved in a Prerogative Court, and his executor's will is proved in a Diocesan Court, the executor of the executor is not the personal representative of the original testator. On the hearing of a petition in this cause, Mr. Hallett, for the Petitioner, referred to Fowler v. Richards (5 Russ. 39), iu which it was decided by Sir J. Leach, M.E., that, when a testator's will is proved in the Prerogative Court of Canterbury, and the surviving exeoutor's will is proved in a Diocesan Court, the executor of the executor is the representative of the original testator, and that it is not necessary that the second will should be proved in the Prerogative Court. the vice-chancellor said that...
