COURTS OF KINGS BENCH
55. JOYNER AND WATTS. Rent. Debt as administrator during minority of four Joyners on lease of Chr. Joyner, and that rent waa arrear to him after death of intestate, not shewing any title; also three are said to be under seventeen years old, and that the fourth was eighteen; and the defendant demurred to the declarati-[608]-on, it not being said what estate the lessor had, which per Curiam is ill, for if intestate had fee, the rent goeth to the heir, and not to the executor; and if intestate were but a termer it must be shewed, and the averment, that one is 18, determines the administration, and the plaintiff amended.

In debt for rent as administrator during minority of six, averring that five are yet under the age of 17, and the other is above; which as Co. Pigots case is ill, but on 22 & 23 Car. 2, cap. 10, 2, Foster for the plaintiff said it was well enough, because he that was of 17 was not [644] able to give a sufficient bond to the Ordinary to talce administration; but per Curiam he may do it by his freinda, and this administration during minority determins when any one comes to 17, as in case of administrator...
