1. The Commissioner’s decision is that, on the balance of probabilities,
Kent Community Health NHS Foundation Trust (‘the Trust’) doesn’t hold
information within scope of the request for changes made to a report
template and has complied with section 1(1) of FOIA.
2. It’s not necessary for the Trust to take any corrective steps.
Request and response
3. The complainant submitted the following information request to the
Trust on 23 September 2023:
“Please could you detail the changes made to Psicon's autism
assessment report template in order to comply with the Advertising
Standards Agency's ruling in case ref: A23-1201817.”
4. The Trust responded on 12 October 2023 – its reference FOI 232. It
advised that it doesn’t hold the requested information.
5. In correspondence to the Trust of 12 October 2023, the complainant
noted a previous internal review of a response to an earlier request
(Trust’s reference FOI 122). That request of 5 July 2023 was for the
template in use on 11 April 2023. The Trust had confirmed that it held
