kernot and another against norman. Saturday, April 19th, 1788. The Court will not discharge a defendant out of custody on filing common bail, on the ground that he has become insane since the arrest. Vide Nutt v. Verney, 4 vol. 121 ; that the Court will riot discharge a defendant though insane at the time of the arrest. [2 B. & P. 362. 6 T. R. 133.] Burrough moved to discharge the defendant out of custody on filing common bail, on an affidavit which stated that he had become insane since the arrest. But The Court said, that a similar application had been rejected some few years ago after argument. Rule refused.
