Act, 1907.
CHAPTER xxvii.
An Act to define and sanction the existing water under- [A.D. 1907.
taking of the urban district council of Keswick in the
county of Cumberland to authorise the construction of
new works to define the limits for the supply of water
and for other purposes. [4th July 1907.]
TTTHEREAS the urban district of Keswick in the county of
"' Cumberland is under the jurisdiction of the Keswick.
Urban District Council:
And whereas the Council in pursuance of the powers of the
Public Health Act 1875 and the Acts amending the same have'
acquired certain lands and waters and interests in lands and
waters and have acquired by purchase and have constructed
certain waterworks which are in this Act described under the
numbers 1 to 14:
And whereas it is expedient that the Council should be
empowered to hold the said lands and to maintain and continue
the said works with the powers and subject to the provisions and
restrictions in this Act contained and should also be empowered
to acquire outstanding interests in lands now occupied and used
by the Council for or in respect of their said works:
And whereas the water supplied by the Council by means of
the said works is derived from certain streams in the parish of
Underskiddaw in the county of Cumberland known as the Mill
Beck the Whit Beck Burr Gill and Applethwaite Gill and it is
expedient that the Council should be empowered to take and
continue to take the waters of the said streams and to supply
such waters within the limits/ oi supply defined by this Act::

1907. And whereas it is expedient that the Council should be
empowered to construct the additional works described in this
Act and to acquire lands waters and easements:
And whereas the said parish of Underskiddaw adjoins the
district and a portion of that parish can be conveniently supplied
with water from the works of the Council and it is expedient that
the limits of the supply of water by the Council should be denned
and fixed so as to include the district and the portion of the said
parish of Underskiddaw and the portion of the parish of Saint
John's Castlerigg and Wythburn defined in this Act:
And whereas the Council have borrowed for and in respect of
their existing works and now owe the sum of seventeen thousand
six hundred and eighty-three pounds fifteen shillings and sixpence
and such sum is charged upon the general district rate and it is
expedient that such sum should be charged primarily on the water
revenue of the Council and be excluded in making calculations as
to the amount which the Council may borrow on the security of
the district fund and district rate for the general purposes of the
Public Health Act 1875 :
And whereas estimates have been prepared showing the cost
of the new works by this Act authorised amounting to six
thousand six hundred and fifty pounds :
And whereas the existing works of the Council and the
works authorised by this Act are permanent works and it is
expedient that the repayment of the cost thereof should be spread
over a period of years.:
And whereas it is expedient that the Council should be
authorised to make byelaws and regulations for the prevention
of waste and contamination of the water supplied by them as
in this Act provided:
And whereas it is expedient that the other provisions of this,
Act should be made:
And whereas an absolute majority of the whole number of the
Council at a meeting held on the thirty-first day of October one
thousand nine hundred and six after ten clear days' notice by
public advertisement of the meeting and of the purpose thereof
in the English Lakes Visitor being a newspaper published and
circulating in the district (such notice being in addition to the
ordinary notices required for summoning such meeting) resolved
that the expense in relation to promoting the Bill for this Act
should be charged on the district fund and general district rate:
