And whereas many
of
the Powers
and Provisions
of
the said recited Act are found insufficient and
defective
;
and
it is expedient that the Powers of the
said
Act should

be altered, varied, amended, and enlarged, and further and more
effectual Powers and Authorities should be given for effecting the
Purposes of the said recited Act: May
it
therefore please Your
Majesty that it rnay be enacted; and be
it
enacted by the Queen's
most Excellent Majesty, by and with
the
Advice and Consent of the
Lords Spiritual and Temporal, and Commons, in this present Parlia-
ProvisionsoE
ment assembled, and by the Authority of the same, That the said
recited Act
recited Act passed in the Fortysecond Year
of
His
Majesty King
extended
to
George
the Third, except such Parts of the same
as
are varied,
this Act.
altered, amended,
or
repealed by this Act, or repugnant to or inconsis-
tent with the Powers and Provisions in this Act contained, shall be
and remain in full Force and Effect, and shall,
so
far
as
they
are
applicable, extend
to
this Act, and be
as
good, valid, and effectual
to
all Intents and Purposes whatsoever fbr carrying the said recited
Act and this -4ct into execution
as
if the same were re-enacted
in
this Act; and that this Act shall be construed with and
as
Part of
the said recited Act.
So
much
of

And be it enacted, That
so
much of the said recited Act
as
recited
Act
appoints Commissioners for carrying the same into execution, and
so
much thereof
is
enables such Commissioners, out of the Monies
as
relates
to
thc Appoint-
ment
of
to
be
raised by virtue and in pursuance of the said Act, fiom Time
Commis-

Time to deduct and retain to themselves, and pay and allow each

shall deem reasonable,
as
and for
a
Recompence and Reniuneration
for their Time and Trouble bestowed in and about the Execution

the said Act; and
so
much
of
the said Act
as
provides for the
Appointment of
a
new Commissioner or Commissioners when and
as
often
as
any Commissioner shall die or become incapacitated or
refuse to act in execution of the Powers thereby in him or them
reposed, and
so
much thereof
as
declares how public Notice
of
such
Vacancies shall be given by the surviving or remaining Commissioner
or Commissioners, and how Meetings shall be called and held for
electing new Commissioners
;
and
so
much of the said recited Act
as
declares what Bodies Corporate and Politic and other Persons
shall be entitled to vote for such Commissioners, or for making,
ratifying, and confirming any Bye Law, Order, or other Proceeding
of
the said Commissioners, and
so
much thereof
as
defines the
Qualification to vote in the Choice
of
Commissioners, or for any
such Purpose
as
aforesaid, and
so
much thereof
as
determines the
Number
of
Votes such Bodies or Persons may give on any such
Occasions
;
and
so
much of the said recited Act
as
empowers any
One Commissioner to determine only upon his own View when it
is
necessary or proper
to
open and keep open the Door or Doors
of
any Clough, Sluice, Shuttle, Staunch, or other Engine; and
so
much
of
the said recited Act
as
renders
it
necessary for the Com-
missioners
in
all Cases to view the Premises before adjudging or
determining what shall be deemed
an
Outring or Division Drain,
Dike or Ditch, Sewer, Drain, Stream, or Watercourse, within the
Meaning
of
the said Act
;
and
so
much
of
the said recited Act
as
empowers any One
of
the Commissioners only upon his own View
to remove or cause
to
be removed Obstructions, Annoyances, and
Inipediments in the Cuts, Drains, and Works; and so much of the

said
Powers,
&e.,
repealed.
