HEREAS the following Acts, Local or Local and Personal Acts,
Whave been passed ; (to wit,) an Act of the Twenty-eighth Year
of

Act for explaining, amending, and making more effectual several Acts of
Parliament relating to the Maintenance and Employment of the Poor of
the Town of
Kingston-upon-Hull,
and for better paving, preserving, and

preventing Obstructions therein, and for preserving the Lamps which shall
be set up to enlighten the Streets of the said Town, and securing the Property

Acts are in this Act called the existing Improvement Acts : And
whereas the several Clauses and Provisions of the fourthly-recited Act
respectively specified in the Schedule C. to this Act annexed relate to
Matters not within the Purview of this Act : And whereas by a Provisional
Order of the General Board of Health, dated the Twenty-third Day of
June
One thousand eight hundred and fifty-one, " The Public Health Act,
1848," (except Section Fifty thereof,) was applied to the whole Borough
according to its present Limits, which was thereby constituted One District,
for the Purposes of that Act ; and by " The Public Health Supplemental
Act, 1831, No. 2,
"
which received the Royal Assent on the Seventh Day of
August
One thousand eight hundred and fifty-one, that Provisional Order
was confirmed : And whereas a Copy of the Provisional Order is given in
the Schedule (A.) to this Act annexed : And whereas the Mayor, Aldermen,
and Burgesses of the Borough are by the Council of the Borough the
Local Board of Health for that District, and in this Act in their Capacity
of

of a Municipal Corporation they are called " the Corporation," and in their
Capacity of such Local Board of Health they are called "the Local Board:"
And whereas the Powers of the Local Board are insufficient, and it is ex-
pedient that their Powers for the Acquisition of Lands be extended, and
that they be authorized to acquire, provide, and regulate Cemeteries for
the Borough, and that their Powers for the Improvement of the Sewerage
and Drainage of the Borough, and for the Prevention of Nuisances, and
for the Construction and Regulation of Buildings and Dwellings, and for
the general Improvement of the Borough, and for levying Rates and
raising Monies, be extended : And whereas, in order to avoid Incon-
veniences arising from several Private Acts relating to the same Purposes
being in force at the same Time, it is expedient that the existing Im-
provement Acts, except the several Clauses and Provisions of the fourthly-
recited Act respectively specified in the Schedule C. to this Act annexed,
and the Provisional Order, be repealed, and that some of the Powers and
Provisions thereof be amended and re-enacted or continued by this Act :
And whereas such Purposes cannot be effected without the Authority of
Parliament : May it therefore please Your Majesty that it may be enacted ;
and be it enacted by the Queen's most Excellent Majesty, by and with the
Advice and Consent of the Lords Spiritual and Temporal, and Commons,
in this present Parliament assembled, and by the Authority of the same,
as follows :
I.
That this Act may be cited for any Purpose as " The
Kingston-upon-
Short Title.

Improvement Act, 1854."
II.
That this Act shall commence and have effect on and from the

That this Act may be put in execution for all the Purposes thereof
within the Borough of
Kingston-upon-Hull,
and for the Purposes thereof
with respect to Cemeteries within such further Limits as by the Provisions
thereof respectively in that Behalf appear.
IV.
That the " Public Health Act, 1848," and the several Acts sup=

respectively are expressly varied by or are repugnant to or inconsistent
with any of the Powers, Provisions, er Purposes of this Act, and except
the First Section and Sections IV. to XXXIV. both inclusive, L. CV.
CXXI. CXXXVIII. CXLI. CXLM and CLII. of "The Public Health
Act, 1848," and except the last Proviso with respect to Exemptions from
rating of Section LXXXVI II. of that Act, are incorporated with this Act.
V.
That the Mayor, Aldermen,
