[22] L'EVESQUE DE OSSERIES CASE IN IRELAND, PORT IN BANG. LE EOY PER bbief d'error sur judgment in B. R. la pasch^e 17 jacobi rot. 314. pars phima. Le Roy per les letters patents direct al Adam a Crofts Seignior Deputy in Ireland le Chancellor & counsel la, &c. I certifye son pleasure, que il ad appoynt un J. Bale d'estre Evesque de Osserye, & pur ceo il eux command de prender tiel order pur son feazanee d'estre evesque come per les orders, & leyes del realm in tiels cases, ont estre uae d'estre observe devant ascun chose est fait, le deputy est change, & un auter est fait deputie ; apres le Seignior Chancellor, & le counsell per un commission, &c. direct al Archdvesque de Dublin & auters pur ceo que ils sont comand, que maintenant ils consecrat le dit J. Bale, mes intant que ne fuit ascun conge de eslier, ou ascun election, puis le defendant J. Bale fuit consecrate, & install in le dit evesquery, & restitution des temporalities & touts ceremonies except le conge d'eslier in le election fuer bien observe; Roy E. 6. mor. (le dit J. Bale esteant home de grand piety & profound learning, & mult zealous in detestation del Pape) in le comencement del Royne Mary pur son safety alast in Germany ; puis le Roigne Mary per ses lettres direct al J. Snellinge Seignior Deputy & auters eux comandant un Tannorye d'estre fait evesque, pur que ils causant un conge d'eslier d'estre fait, per que ils elect consecrate, & instal, & ad touts auters ceremonies requisite pur fezant d'evesque, pur que le dit Tannery fuit evesque per tout le raigne del Royne Mary; apres le Roigne Mary morust, & in comencement del raigne del Roigne Eliz. Bale revient & deins 3 ans mor. Apres 4 Eliz. Tannery fait lease pur 100 ans & mor, & puis un Whiler fuit create evesque la, que port son action in B. Roy in Ireland pur avoid ceo lease, & judgment fuit done pur luy la, sur que le lessee de Tannery port brief d'error icy. Sir John Davies argije pur le lessee de Tannery, que port brief de error icy. 3. points. 1. Si Bale poit estre [23] loyal evesque sans conge d'eslier & election. 2. Admittant luy d'estre fait duement, an Tannery que vient eins per comission & lettres del Roigtie Mary per un conge d'eslier election, sans consecration, installation, & touts auters judicial Acts, s'il serra dit evesque durant le vie del dit Bale. 3. S'il ne puit, s'il serra eveaque 960 pasch^; 17 jac. regis palmer, 2*. de facto apres le mort de Bale.
