In exercise of the powers conferred on me by section 15 of the Legal Aid (Scotland) Act 1967(a) and sections 1 and 11 of the Legal Advice and Assistance Act 1972(b) and of all other powers enabling me in that behalf, I hereby make the following regulations:—

1.—(1) These regulations may be cited as the Legal Advice and Assistance (Scotland) (Financial Conditions) (No. 2) Regulations 1979 and shall come into operation on 6th April 1979.

(2) In these regulations, "the Act" means the Legal Advice and Assistance Act 1972 and "the 1978 Regulations" mean the Legal Advice and Assistance (Scotland) (Financial Conditions) (No. 2) Regulations 1978(c).

2. For the weekly sum of £52 specified in section 1(a) of the Act as amended by the 1978 Regulations, there shall be substituted the weekly sum of £75.

3. For the capital sum of £365 specified in section 1 of the Act as amended by the 1978 Regulations, there shall be substituted the sum of £600.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These Regulations increase the disposable income limit for the availability of legal advice and assistance from £52 a week to £75 a week and the disposable capital limit from £365 to £600.
