In exercise of the powers conferred on me by section 15 of the Legal Aid (Scotland) Act 1967(a) and sections 1 and 11 of the Legal Advice and Assistance Act 1972(b), and of all other powers enabling me in that behalf, I hereby make the following regulations:—

1.—(1) These regulations may be cited as the Legal Advice and Assistance (Scotland) (Financial Conditions) (No. 3) Regulations 1983 and shall come into operation on the day after the day on which they are approved by resolution of each House of Parliament.

(2) In these regulations, "the Act" means the Legal Advice and Assistance Act 1972.

2. For the purposes of section 1(a) of the Act, there is hereby prescribed the weekly sum of £103 in place of the weekly sum of £99 prescribed by the Legal Advice and Assistance (Scotland) (Financial Conditions) Regulations 1983(c).

3. For the purposes of section 1 of the Act, there is hereby prescribed the capital sum of £730 in place of the capital sum of £700 prescribed by the Legal Advice and Assistance (Scotland) (Financial Conditions) Regulations 1983.

4. The Legal Advice and Assistance (Scotland) (Financial Conditions) Regulations 1983 are hereby revoked.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These Regulations increase the disposable income limit for eligibility for legal advice and assistance under the Legal Advice and Assistance Act 1972 from £99 a week to £103 a week and increase the disposable capital limit from £700 to £730.
