The Lord Chancellor, in exercise of the powers conferred on him by sections 1 and 20 of the Legal Aid Act 1974(a), hereby makes the following Regulations:—

1.—(1) These Regulations may be cited as the Legal Advice and Assistance (Financial Conditions) (No. 4) Regulations 1977 and shall come into operation on 28th November 1977.

(2) In these Regulations, unless the context otherwise requires, "the Act" means the Legal Aid Act 1974 and other expressions have the same meaning as in that Act.

(3) The Interpretation Act 1889(b) shall apply to the interpretation of these Regulations as it applies to the interpretation of an Act of Parliament.

2. For the weekly sum of £42 specified in section 1(1)(a) of the Act, as amended by the Legal Advice and Assistance (Financial Conditions) (No. 2) Regulations 1977(c), there shall be substituted the weekly sum of £48.

3. For the capital sum of £300 specified in section 1(1) of the Act, as amended by the Legal Advice and Assistance (Financial Conditions) (No. 2) Regulations 1976(d), there shall be substituted the capital sum of £340.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These Regulations increase the disposable income limit for the availability of legal advice and assistance under the Legal Aid Act 1974 from £42 to £48 a week and increase the disposable capital limit from £300 to £340.
