APPEAL UNDER REGULATION 29 OF THE RAILWAYS INFRASTRUCTURE (ACCESS &
MANAGEMENT) REGULATIONS 2005 - ACCESS TO THE PORT OF FELlXSTOWE WHERE
FELlXSTOWE DOCK AND RAILWAY COMPANY IS THE SERVICE PROVIDER
Thank you for your letter dated 6 July 2010 containing a copy of Hutchison Ports (UK)'s
('HPUK') comments on the information supplied to ORR by DB Schenker Rail (UK) Limited ('DB
Schenker') in its letter dated 8 June 2010.
Unsurprisingiy, DB Schenker disagrees with HPUK's view that the information contained in DB
Schenker's letter dated 8 June 2010 is consiste nt with Felixstowe Dock and Railway Compan y
('FDRC')' s submiss ions in respect of the appeal. In particular, DB Schenker notes that in its
letter HPUK states that
'it would be reali

c to increase the number of daily trains operating to/from the freight
terminals at Felixstowe from 28 currently to 30 and poss ibly 32 provided such train paths can be
found on the Felixstowe to Ipswich branch line which is ama tter f
or
Network Rail and the freight
operators. However, this was expressed to be subject to the cavea t that the increase is only
possible
if
the freight operators reduced the amount of time some of the existing trains dwell on
the terminals. ...'
DB Schenker ackno wledges that it is aware of t his caveat being expressed. However, it is clear
from the record of HPUK's discussions with OfT (Appendix 3 of DB Schen ker's submission to
ORR dated 31 March 2010) that the caveat only applied to the increase in capacity from 30 to
32 trains, not 28 to 32 trains as HPUK now suggests . To quote paragraph 3.2 of that record:
'Having regard to train utilisation and the number of working days, it was agreed with OfT Rail
that 30 trains per day is achievable and 32 would be possible
if
the freight ope rators could
reduce the amount of time some o
f/
he trains dwell on the terminals ....'
DB Schenker's application, if accepted by ORR , would result in an increase in train paths at the
Port of Felixstowe from 28 to 29 per day which HPUK agreed in its discussions with OfT Rail is
achievable without being subject to the caveat (i.e. a seemingly different position to that taken
by FDRC in respect of the appeal).
