[155] lewis -uernis whitton, vel witney. Sentence done vers un en un Court Christian pur parols de defamation al suit del party, & condemne. Les parols fuer Thou art a pander, and a pander to Sir Henry Vaughan, the sonne of Tucker. Apres le defendant appeal al Arches, donque vient un pardon del 21 Jac. que relate ouster le temps des parols, p q^ 1'offence fuit pardon, sur que le appellant desert son appeal, le Court del Arches tax costs vera luy. Primierement, fuit agree per totam Curiam & les counsel de ambideux parts, a apres le pardon ceux en le Inferiour Court ne poyent tax costs. Mes Serjeant Richardson urge fortment, que le Superiour Court poyent icy nemy sur le sentence, mes aur le desertion del appeal, que est puisne al pardon. Trotman al eontr, quia quand I'offence eat pardon, est tin vaine chose pur le party de prosecute son appeal. Et ne poet estre tax pur deserting, quia le reason del tax en tiel case est, le veratious suit. Mes icy le reason fayle; quia est nul reason de prosecute son appeal, quand 1'original offence est pardon. Jones accord, ^ p le pardon del offence le tax del costs est ale ; & pur c le desertion del appeal fuit bien fait. Quia en les Arches ne poyent allow le pardon,, quia ils solement enquire del iniquity del sentence. Doderidge accord, il ne poet plead le pardon en le Superiour Court Christian, lou le primer sentence fuit done. Et Dodendge dit, que si le appellant meame transmit le proceedings del Inferiour Court; donque nul reason d'assesse costs, quia il mit luy mesme al le charge. Richardson, Comment^ le transmitting, est al charge del appeller, nous suraua mit al charge des copyes, & counsel. Adjourn. Mes Doderidge dit ut supra.
