Act
for
making and maintaining

Railway
or
Tramroad
from the
Town
of
Liverpool
to the
Town
of
Manchester,
with certain Branches
therefrom, all in the County
of
Lancmter.

HEREAS
the making and maintaining of a Railway
or
Railways, or Tramroad or Tramroads, together with
the
Two several Branches therefrom herein-after mentioned,
with proper
Works
and Conveniehces adjoining thereto
or
connected
therewith, for the Passage of Waggons and other Carriages, from
or
near the Town
of
Liverpool
in the County of
Lancaster,
in and
through the several Parishes or Places herein-after mentioned, to the
Township of
Sarord
within the Parish of
Manchester,
and adjoining
to
the Town of
Manchester
in the same County, will be of great
Advantage to the Inhabitants of the said County, Towns, and Places,
by opening
a
cheap and expeditious Communication between the
Two large trading Towns
of'
Liverpool
and
Manchester;
and
by
affording an additional Mode
of
Transit for Merchandize and other
Articles and Matters between these Places, and also to and from the
neighbouring Country, will be of great public Utility
:
And
whereas
the King's most Excellent Majesty, in right
of
His
Dslchy
of
Lan-
caster,
is entitled to certain Lands in the Township
of

over which the proposed Railway
is
intended
to pass: And whereas the several Persons herein-after named are
willing and desirous, at their own Costs and Charges, to make and
maintain such Railway or Tramroad and Branches; but the same
cannot be effected without the Aid and Authority
of
Parliament
:
May
it
therefore please Your Majesty that it may be enacted; and be
it
enacted by the King’s most Excellent Majesty, by and with
the
Advice and Consent
of
the Lords Spiritual and Temporal, and Com-
mons,
in
this present Parliament assembled, and by the Authority
of
the same, That the Most Noble

and Persons, Body and Bodies Politic and Corporate, who shall
hereafter become Subscribers to
the
said Undertaking, and their
several and respective Successors, Executors, Administrators, and
Assigns, shall be and hereby are united into a Company for malting,
completing, and maintaining the said Railway or Railways, or Tram-
road or Tramroads, and Branches and other Works by this Act
authorized to be made and executed according to the Rules, Orders,
and Directions herein-after mentioned,
and
for that Purpose shall be
one Body Corporate, by the Name and Style
of

.Manchester
Railway Company,” and by
that
Name shall have per-
petual Succession, and shall have a Common Seal, and by that Kame
shall and may sue and be sued; and the said Company shall have
Power and Authority, from and after the passing of this Act, and at
all Times thereafter, to purchase and hold Lands and Hereditaments
to them and their Successors and Assigns, for the Use
of
the said
Undertaking and Works, and also to sell and dispose of the said
Lands and Hereditaments again, in manner
by
this Act directed,
without incurring any of the Penalties
or
Forfeitures
of’
the Statute
of
Mortmain.

And be it further enacted, That the said Company shall be and
empowered
,hereby are authorized and empowered, by themselves, their Deputies,
to

Agents, Officers, Workmen, and Servants, to make, complete, and

maintain a Railway or Railways, or Tramroad or Tramroads, with
Manchester.
proper Works and Conveniences adjoining thereto or connected there-
with, for the Passage
of
Waggons, Carts, and other Carriages properly
constructed, commencing at the Place delineated on the Plan, and
described in the Book
of
Reference deposited with the Clerk
of
the

some of them, and terminating at or near to the South-west Side
of
the
New Bailey
Prison, in
the
Township
of
SaEford
in the Parish
of
Manchester,
and near
to
a
certain Bridge over the River
IrweU
called
The
New
Bailey
Bridge,
leading to
or
communicating with the
Town of
Manclzester,
all within the County Palatine
of
Lancaster
;
together with Two Branches from or out
of
such Railway or Railways,
or Tramroad or Tramroads, commencing at
or
near to certain Closes
or
Lands called
The Ridings,
in the Township
of
Whiston
in the Parish
of
Prescot
aforesaid
;
and thence extending respectively, the one
Branch Northwardly into and terminating in or near to a certain Close
or Field in the Township of
Whiston
aforesaid, on the North Side
of'
or near
to
the Road leading from
Whiston
to
Huyton,
and opposite
or near
to
Whiston
Potteries
;
and the other Branch Southwardly, into
and terminating at or near certain Lands
or
Closes called
The Lower
Houghton Heys,
in the Township
of
Whiston
aforesaid, all within the
County
of
Lancaster;
and also to make and maintain inclined Planes
on such Parts ofthe said Line as may appear to the said Company
to
be
necessary.
111.
And
be
it
further enacted, That for the Purposes of this Act
Power
to
the said Company, their Deputies, Servants, Agents, Surveyors, and
take
Lands,
Workmen, shall be and they are hereby authorized and empowered

to enter into and upon the Lands and Grounds of'any Person or Body
Politic, Corporate,
or
Collegiate whatsoever, according to the Provi-
sions and Directions of this Act, and to survey and take Levels
of
the
same, or any Part thereof; and to set out, ascertain, and appropriate,
for the Purposes herein mentioned, such Parts thereof as they are by
this Act empowered to take or make use
of
for making and using the
said Railway or Tramroad, and all such other Works, Matters, and
Conveniences as are hereby authorized to be made, and there to bore,
dig, cut, trench, embank, and sough, and also to remove, take, carry
away, lay, and use any Earth, Clay, Stone, Soil, Rubbish, Trees,
Roots
of'
Trees, Beds
of
Gravel
or
Sand, or any other Materials
or
Things which may be dug, raised, or gotten in making the said Rail-
way
or
Tramroad, and other Works, out
of
the
Lands
or Grounds
of
any Person, or Body Politic, Corporate,
or
Collegiate, adjoining
or
contiguous
to
such Railway or Tramroad, which may be groper,
requisite, or necessary for making, carrying on, continuing, main-
taining, altering,
or
repairing the said Railway
or
Trainroad, and other
Works,
or
which may hinder, prevent,
or
obstruct the
making,
wing,
or
